These Terms of Use are entered into by and between You and MC Home Enterprises LLC, doing business as John McClain Design, Design Success Academy, John McClain, and The McClain Method (“Company,” “we,” or “us”).

These Terms, together with our Privacy Policy and any additional policies referenced herein, govern your access to and use of:

Any related digital programs, services, coaching, templates, or content—including content delivered via private platforms such as Instagram Close Friends.

By using these websites or engaging in any associated content, you accept these Terms. If you do not agree, please refrain from accessing or using our materials or services.

1. Eligibility
You must be 18 years of age or older to use this Website. By using the Website, you represent that you are of legal age and agree to these Terms.

2. Updates to These Terms
We reserve the right to modify these Terms at any time. Updates will be posted on this page with an updated effective date. Continued use of the site constitutes acceptance of the modified Terms.

4. Intellectual Property
All content on the Website and in any of our programs is owned by MC Home Enterprises LLC. You are granted a limited, non-transferable license for personal or internal business use only. 5. Paid Programs, Courses & Templates
When purchasing any course, download, or membership, including Design Success Academy and The McClain Method, you agree:

Content is for individual use only.

You may not share logins or distribute content.

Contractors and third parties may not access materials unless expressly permitted.

You may share your login with up to two full-time employees, if registered. Contractors and collaborators are not eligible.

6. Close Friends + Instagram Content
Any content provided via Instagram Close Friends (e.g., @johnmcclaindesign or @themcclainmethod) is exclusive to active, paying members. Sharing, screenshotting, screen-recording, or reposting this content is strictly prohibited.

Violation may result in immediate termination without refund and may lead to legal action.

7. Coaching Programs & Disclaimer
By engaging in our coaching programs, you acknowledge:

You are solely responsible for your results.

John McClain and affiliated coaches are not licensed attorneys, therapists, or financial advisors.

Coaching does not constitute legal, financial, medical, or psychological advice.

We do not guarantee results, earnings, or business outcomes.

8. Refund Policy
We offer a 14-day money-back guarantee on eligible programs. To qualify, you must:

Submit completed coursework

Explain why the course was not a fit for you

Submit your request to: hello@johnmcclain.co

After 14 days from Module 1 release, no refunds will be issued. Chargebacks will be treated as a violation of these Terms.

9. Community Guidelines & Conduct
In all forums, calls, and coaching spaces, you agree to:

Be respectful and inclusive

Not harass, threaten, or spam others

Not promote competing services

Not share others’ private information

Violation may result in termination from all programs without refund.

10. Confidentiality
All information shared within our coaching or membership programs—including inside group calls, private communities, and comments—is confidential.

You agree not to:

Disclose program content outside the membership

Share proprietary systems, downloads, or methods

Discuss other members' private content or posts

This clause survives even after membership ends.

11. Limitation of Liability
We are not liable for:

Any direct or indirect losses or damages from your use of the Website or programs

Decisions made based on information provided

Technical delays or service interruptions

All services are provided “as-is” without warranties.

12. Indemnification
You agree to indemnify and hold harmless the Company, its employees, and contractors from any claims or liabilities related to your use of the Website or participation in programs.

13. California Jurisdiction
This Agreement shall be governed by and interpreted in accordance with the laws of the State of California, without regard to conflict of law principles.

Any disputes shall be resolved via binding arbitration in Los Angeles County, California.
